EU AI Act Article 3(40): an AI system assigning natural persons to categories based on their biometric data, such as inferred sex, age or ethnicity. Prohibited under Article 5 in narrow circumstances (inferring race, political opinions, trade union membership, religious beliefs, sex life or sexual orientation) and listed as high-risk under Annex III otherwise.
